On 24th June, after much negotiation by email I �sold� a VHPD and standard Elise engine to a chap in the Netherlands. I carefully set out what was included in the �sale� parts wise and that the �sale� was conditional on a deposit of �300 being paid immediately into my bank account with the balance being paid within 28 days, ie by 22nd July. He agreed to the terms I offered and the �300 was paid.
He still has not paid the balance for the goods and after an exchange of emails he now says he does not have the cash until he sells a car but is �hopeful� he will have the cash next week. I get the impression he�s messing me about. Oh, and his emails have gone from very shaky English to perfect sentence structuring.
I�ve informed him that unless the money is forthcoming this week I�ll be selling the engines elsewhere.
To add this chap converts rhd Elises to lhd and has a number of spare rhd racks. We agreed a price on one of these (v low mileage) and then bugga me he tells me subsequently he�s sold it elsewhere!
Just interested in the views of what action any of you would take?? And what would you do with his �300 deposit.
Give him another week then have a good night out on the �300 !! thats the idea of a deposit, to hold until balance is paid, if he dosent pay the balance, tough

I wouldn’t disagree at all, that you’ve been more than reasonable so far, but another week won’t make much difference! In the meantime re-advertise - if you get a punter, it’ll probably take a few days for them to transfer a deposit to you!
I’d still send the original deposit back though, if you re-sell for at least what you were originally expecting, but that’s just me! I can also 100% see where Chris is coming from, but he earns his living in the motor/motorparts trade.

Whats the point of leaving/giving a deposit if you are going to give/expect it back if you dont complete the deal ??

You would be well within your rights to re-sell those engines and claim any shortfall of the agreed sale price from him, you have a contract of sale and he has failed to honour his agreement to purchase.
Chris - the “buyer” may, or may not be expecting the deposit to be repaid, I don’t know, cos Simon hasn’t said. Either way, you are 100% correct with the above
Hope Simon sells the engines soon, & promptly gets the full amount agreed.
Simon, I would hang on another week and if nothing sorted would send back the deposit less what you had agreed to pay for the rack. Advising him that I would release the balance after he has provided a rack in the condition agreed within (say) 60 days. Otherwise you would retain the balance of the deposit. At least then you will either get the rack or retain an amount for being fecked around.
I would wait the week, then you have made reasonable endevours to allow him to complete the transaction. I would give him notice that he has 5 working days to provide the funds and if this is not met you will return the deposit less your costs for advertising/time.
If you keep the deposit, you can also afford to sell the engine cheaper and still get what you want for it, plus it may well sell quicker at a cheaper price.
