they pulled me over…
Did they pull you over or have you been informed by post?
marc.
exigeboy,
Your good record should help when the length of ban is being decided, as will a guilty plea.
I got 6 months for two ‘6 pointers’ (both speeding), with the second being 92 in a 60 If it had not been for a quick witted court clerke, I may have got away with 2-4 weeks.
Good luck with it , it sounds like you’ve learnt your lesson already (but that plea won’t help either )
Tim.
thanks Tim - what was the court process like? is it quick? should i get a solicitor?
Offence to ban took about 7 weeks. But thats in rural Cumbria, maybe different in London?
I personally never bothered with being represented. You will get a chance to have your say, so tell 'em of your unblemished record then IMHO.
On court day, get in early (by bus ) & get seen asap, otherwise you could end up waiting with the great unwashed in shell suits ‘n’ tats
Tim.
sorry to hear this fella whatever speed you were doing.
It’s easy to miss the signs. I got dobbed several years ago in the MR2 on the M621/M1 out of Leeds. Its a 50 zone dual carriageway. Copper pulled out and followed me up the slip ramp and down the mway. It was empty and I gradually brought the speed upto 75/80. He followed me for ages then pulled me. He thought I hadn’t seen him but I noticed him parked up as I set off from the lights. Gave me 3 points instead of 6/poss court appearance. I thought that was fair but I genuinely didn’t see any signs - git.
Might be worth paying a specialist to check all the road signs are correct, the lines in the road and the signs match etc… Even if they are a bit out it could get thrown out of court.
If you do go to court try and find out who the duty brief is see if you can get 10 mins with him b4 he/she starts.
I did this for an accident I had and he did a toppermost job for me giving it rock all re my many years of blemish free motoring etc… He knew what to say and when to say it. I turned up in mi best suit - it all helped (especially when the other individuals waiting for their turn looked like the rejects from a chav fest, some were even threatening each other with their respective breif’s sat with them - total madness).
I got a the smallest fine and 3 points. I wont go into detail but basically I was mega unlucky. I turned right into a junction after a van had passed. I did not see a car which was speeding (witnessed) behind the van. He braked and skidded following me into the junction. He hit my car and turned it on it’s side!!! Had he not braked he would have gone straight past
They did me for due care coz I admitted not seeing him - i.e. not taking enough care FFS
It was punishment enough having to sit with the scum of society waiting my turn.
Good look and as Mr Admin says do as much research as poss.
If nowt turns up get the duty man to evidence you are christ reborn and it should help.
Going in there as captain cocky the cockiest man alive wont do you any good
wow a few posts since i started typing! see what I mean about the unwashed masses - feckin horrid. I couln’t wait to get out of the bloody place!
thanks mhaney
if i do get banned, is there any point appealing?
Did you happen to see the 5th Gear with Nick Freeman (aka, Mr. Loophole - although his given surname seems appropriate enough)?
i did, i have a feeling i come under the ‘only in more serious cases is a ban inevitable’ blurb
not sure fella - again I would talk to a specialist b4 doing anything else. I would certainly pay for some advice but take care not to get drawn into an expensive legal battle - cant see you would win.
If you can evidence in any way the signs were not clear or you were distracted by something you might get some sort of mitigating circumstances/throttle cable stuck/wasp in the cockpit/lost concentration - got to be careful as they might also do you for careless driving???
I think you are on thin ice but if theres a chance of reducing the possible outcome without making it worse it has to be worth a try.
I had 9 points at one time now all gone 5 years clear. I really do make an effort in 30s and 40s it is less painful than the cost of those points on my insurance for so long - and with 3 cars to insure it really is expensive over that length of time. Insurers count all penalties for 5 years in my experience.
After the incident in my Exige 2 weeks ago I have almost given up on the idea of trying to enjoy the Exige on the road feckin rozzas
sorry boys if you have seen this before - it’s long post - cant remember if I posted it on here?
Anyway if yr interested read on - it’s about being caught by the fuzz…
was on way home last night in Exige (late of course, as usual - two friends at home waiting for me Pizza in the oven etc…)
Was in an unrestricted area in the sticks and happened upon a line of 7 cars or so. Slowed down behind the 3.2 V6 vectra in front pausing for a second or so to see if he was going to take the other cars as they were doing 40!
He didn’t so of I went round the vectra. Pulled to the left to look down the inside then out, indicating and passed the lot with scotty reporting he had given me every thing she has captain. Passed the lot no dramas, pulled in and stamped on the brakes when hitting the 40 zone ahead (just do that to see how well it stops )
A few seconds later I have a rock concert light show in my rear view mirror - the light being predominantly blue!!!
Where the donald duck did that come from? - couldn’t tell what it was in the mirror - the lights were fairly bright.
OOPS!
I assumed that I needed to pull in for my license taking off me.
Jumped out of my motor straight into the passenger side saying oops and where the fook did you come from??? (It was the silver Vectra - barstewards - never noticed anything on the car to indicate a copper and I pride mi sen on noticing them!!!)
Twas a Lady traffic officer about my age. “Lets look at that on the video” she says as the fancy motorised screen emerged from the dash board.
After several seconds of it ‘not working’ and me saying to her I hope it’s bust…It of course burst into life.
Oh ace it’s got a rearward facing camera as well which she fired up as soon as she saw me in the distance. Superb shot of me steaming up behind, pausing, indicating then nipping round the vectra. Next we see the overtake of the row of cars and me off out of sight. I come back into picture with brake lights lit b4 hitting the 40 zone. We then see how slow a 3.2 vectra is at catching up…and how not to overtake safely in one !!!
So theres me apologising and calling mi sen a cock etc…
She then talks me through it and basically says she cant fault me on my driving or observations, a perfect overtake etc…apart from not noticing her car
I technically had done nothing wrong. I waited for the broken white line b4 indicating and pulling out. The road was clear, I checked both sides for traffic, cyclists and oncoming, because the traffic was doing 40 I passed them all without her having chance to correctly note my speed (not that I was speeding of course). Then slowed down with the evidence of my brake lights for the 40 zone.
Still expecting to get a proper fooking for something I produced my licence and she did all the checks for insurance and if I was on the run etc… All ok. She didn’t even bother looking at tyres, number plate or owt (it is all bang on anyway).
She then told my she flashed the front strobes as I pulled in front of her just to warn me she was there as I had obviously not seen her
Next a tour of her car where she turned everything on to show me how to recognise it in the future.
She sent me on my way with a lecture and to calm down a bit
Phew - I was Tom Tittin mi sen!
So I suppose the moral of that story is that one can still drive ‘with spirit’ and not get done (but you might get pulled over anyway). Just make sure you dont have an attitude problem with them or it’s curtains!
She was very, very professional and extremely pleasant - not arsey in any way.
I was of course very apologetic even though I was clean as a whistle.
I reckon I would have been dry bummed for summat if it had a been a bloke.
My copper chums (the guys I was off home to see!!!) said she could have found something if she really wanted to and advised that when dealing with the filth one is always better taking whatever is said and being as nice as possible.
a few days later one of the lads was telling me he thought his bike would have hit 170 instead of the 167 he did get to on the same stretch of road!!! holy cow and I’m worried
Stress that you need your licence for your job, this may or may not help as it all depends on how the judge feels on the day, I was caught doing exactly 100 mph on the M74 by a mobile camera. I pleaded guilty by letter including an A4 sized appology and recieved 5 points and a 300 fine. NO BAN.
on the topic of speeding do you guys down south have one of these yet…
All I can say is get a Lawyer. I got done for 93 in a 30 when I was 18 (i’m 24 now, so this is quite a while ago). It was 6:00am and there was no one on the road at all, and I was late for work. I am not proud of it, I don’t drive fast on the road anymore, so nobody need bother lecture me. lol
I went to court with 6 points already and was looking at a worst case of 2 years in jail, a 5 year ban and a 2,000 fine!!!
I got a good lawyer, his 10 minutes cost me 600 and I walked out with only 6 points and an 80 fine. These points added to the 6 I already had meant i did get banned for 6 months. I have to say though, I got into cycling and I have never been so fit before or since, so every cloud and all that. Good Luck!!
58mph in a 30 zone cost me 5 points and 450 quid fine. Wasnt in town/city but on a country road approaching (but still 500m away from) a small village.
Jim
I’ve got a court date just come through after being caught at 87 in a 60 on the MLOC trip to Hethel in Feb.
Just happens to be 1mph over the 3 point limit. I’m hoping for 4 points and a fine, however if I start crying I may get off scott free
Definitely get letters to state your good character and that the car is essential for you to keep your job. Be very appologetic and don’t mention “bastards”, “stealth tax” or “nanny state”
Good luck.
well exigeboy as the day grows old people are now showing a little more compassion towards you!!! don’t worry to much… we have all been there. good luck pal
Oooft unlucky mate, suppose most of us have had times when we could have been caught doing similar but though it safe at the time…
ALLEGEDLY i was caught doing 62.5mph in a 30mph zone
ban? how long for? plan of attack?
They pulled you over… did they show you the reading?
yes - i was surprised they got me at 486ft tbh
