please only answer if you are in-the-know - I want accurate info only!!
that sounds like a really bad day!
- can you be done for speeding if tailed by an officer on his/her own i.e. without an accompanying officer?
Yes, but he will need some corroborating evidence in some form or another. This could be speed measuring equipment, independent witness statements etc.
- can you be done for speeding if tailed by an officer in an unmarked car?
Yes, it’s irrelevant whether the car is marked or not.
- can you be done for speeding if tailed by an officer in a marked car but without a video recording device?
Yes but there must be some form of corroborative evidence that will support the officer’s allegations. Either that or a confession from yourself after being stopped and cautioned before you were questioned. Confessions on their own though are not totally reliable as evidence upon which to prosecute.
- can you be done for speeding if tailed by an officer in a marked car, with a video recording device, but who tailed you only briefly? or perhaps had to accelerate to catch you, by which time you had slowed down?
Slightly trickier… but ostensibly yes if the distance over which he followed you satisfied the criteria required under the circumstances. The video kit is based upon an average speed calculated over a known distance. These calculations are subject to human error, as the officer is responsible for starting and stopping the measurement. I would guess that if he had been following you at a constant distance for a while before you noticed him and had a constant view of your vehicle, then he probably only sped up to pull you over
- is it illegal to record the converation that you have with an officer, having been pulled over, either audio only or video?
It’s not illegal, but unless the officer is saying or doing something outrageous then it will be of little use unless at the time he didn’t indicate or stated there would be no official follow up and now you’ve received a summons. Need to know more detail here really.
- what are the powers to search the vehicle that an officer has?
If you’ve been stopped for a Traffic offence then none directly. However once stopped if the officer reasonably suspects you to be in possession of any stolen property, controlled drugs or prohibited articles then he may conduct a search of you and/or the vehicle - this would be deemed to be a PACE Stop and Search and you would be entitled to a copy of the notice that the officer would have to submit back at his station. This would provide details of the grounds for the search, the object of the search, the identity of the officer carrying out the search, the station at which he is based and your entitlement to a copy of this notice.

Ian - thats very helpful - many thanks. I havent actually been pulled over, I was just curious. Do you know the answer to the last question? I had heard that if flashed by an unmarked car, you have the right to drive to the nearest station rather than pull over, if you think that the driver is not actually a real police officer. Is this correct?

Sorry missed this one… Well this is actually a defence to failing to stop when required to do so by a constable in uniform (can be a plain car though!)It’s not actually a right and you may have to convince a court that the officer wasn’t readily identifiable and you therefore drove and stopped at the nearest safe public place or Police Station because you were fearful of your personal safety.
