Help! claim previous owner

Hi

Just had a strange phone call from a loan underwriter. He claims there is still an open balance of GBP 22.000,- on my car!
I bought my Exige from Swifts/David Underwood back in 2008!
It seems Swift is bankrupt at the moment.
Car is registered on my name as the second owner of the car (since 2008).

Can the underwriter claim my car back?
I have had several upgrades since! and the price of the car was right at the time I bought the car.

Did you have an HPi done on the car when you bought it?

Run an HPi again and check, AFAIK if there is outstanding finance on the car you legally have never owned it just been a registered keeper, this is very bad luck if it is the case, hope it all works out for you

Bought My Exige CUP in August 2008. Swift several Exiges and 211’s for sale at that time. Asked here and on Seloc to look at the car in Sheffield. I was looking for a CUP in specific colour for a while and this was the only one available. In the mail I got from this company it states that the car is HPI clear. I didn’t check it myself!

Car is not in the UK at the moment. Our law is different. Have to check what will happen now (but at least no more trackday’s in the UK for a while).

Interesting that Swifts have gone to the wall - they had cars up for sale at their premises last weekend :wink:

Strange it has taken the loan underwriter so long to contact you unless Swift’s have being paying the due installments in the interim? - until their demise.

I think that if you have proof that they told you it was hpi clear you may be classed as a ‘bona fide purchaser for value without notice’ and you may well be ok - as it is Swift’s who gave you the false information they will have to be pursued for the outstanding amount by the ‘lone’ ranger.

Yeah I’d be arguing that is’t credit fraud by swifts on your car.

Was this a chrome orange cup?
I looked at one early in 2008 in Cheshire and found it was also advertised at Swifts and this put me off it.

Bingo!

Car was on D’s name and was the first owner. Car looked very clean (but is now even better).

I looked at the Cheshire car as well, but this was another one (Mick H’s car).

Was the one in Cheshire at a private house? As I remember it was a trade advert and when I wanted to see it the said they had to ‘get it over’.
